CERC Extends Deadline for ISTS Waivers for RE Projects

The Central Electricity Regulatory Commission (CERC), in its latest suo motu order, allowed an extension of the waiver of Inter-State Transmission System (ISTS) for renewable projects. It implies those wind and solar projects whose generation capacity was declared under commercial operation earlier between February 13, 2018, to December 31, 2022. 

These projects were given ISTS waivers under the CERC (Sharing of Inter-State Transmission Charges and Losses) Regulations, 2020.  These waivers were earlier applicable only till December 31, 2022. However, the Draft CERC (Sharing of Inter-State Transmission Charges and Losses) (First Amendment) Regulations, 2022, issued on June 11 last year, proposed an extension of the final dates. 

On December 30, 2022, the central agency extended the dates till June 30, 2023, or till the notification and effectiveness of the First Amendment to the 2020 Sharing Regulations, whichever was earlier. The CERC (Sharing of Inter-State Transmission Charges and Losses) (First Amendment) Regulations 2022 (First Amendment Regulations) was notified on February 7, 2023. However, the central agency said that the provisions of the regulations had not been brought into force.

Keeping in mind these developments, the CERC has extended the deadline to October 1 or until the first amendment regulations come into effect. 

“Since it would take some more time till the First Amendment Regulations are brought into force, in order to remove difficulties in the stated facts and circumstances, we in exercise of power under Regulation 28 of the 2020 Sharing Regulations and in continuation of Order dated 30.12.2022, hereby extend the timeline specified in Regulation 13(1) (c) of the 2020 Regulations till 1.10.2023 or till the First Amendment Regulations comes into effect, whichever is earlier,” the order from CERC said.
