GameChange BOS Shields 380 MW+ Solar Projects Amid FEOC Rules
United States-based GameChange Solar is helping solar developers and EPCs preserve over 380 MW of projects following the elimination of the 5% spend test and new physical work requirements under the latest US Treasury updates. Its Balance of System (BOS) solutions, including GameChange BOS transformers, are now being used in over 75 distributed generation and community solar projects.
These solutions help maintain eligibility for the 30% tax credit, often reducing project costs by $2–5 million—even when permitting delays or other factors prevent projects from breaking ground onsite.
While GameChange BOS is helping developers navigate FEOC compliance and preserve tax credits, US regulators are also closely monitoring other aspects of the solar supply chain. Recently, Indian solar EPC company Waaree Energy came under scrutiny from US Customs over concerns that it may have sidestepped tariffs on imported solar cells and modules.
Navigating US FEOC Policy
Naving the tricky Foreign Entity of Concern (FEOC) policy, GameChange Solar explained that under the revised Safe Harbor guidance, physical work must be completed by the end of this year for projects containing FEOC equipment. It also set an additional compliance window for the project from January 1 to July 4, 2026 for all other projects.
Since many projects are still awaiting utility, environmental, or local approvals, this requirement poses significant challenges for developers trying to maintain realistic timelines while qualifying for the tax credit.
