Job Description

Currently we are looking for a Compliance Officer in New Dehli, India to be part of our global team working together towards our vision – Improving our future. As our Compliance Officer you required monitoring and reporting results of the compliance/ethics efforts of the company and providing guidance to the Executive Committee on matters relating to compliance, as well as reporting and liaising to and with the designated Compliance Officers of Scatec. The Compliance Officer is authorized and expected to implement all necessary actions to ensure achievement of the objectives of an effective compliance program by merging the best of relevant policies and processes existing in Scatec.

Main responsibilities:-

  • Adapt, initiate, maintain, and revise policies and procedures for the general operation of the Employer’s Legal and Regulatory Compliance Program to prevent illegal, unethical, or improper conduct (hereafter called compliance program). The compliance program should be designed to be compliant with the requirements in Brazilian clean company act and all other relevant laws and regulations that regulate implementation of the Employer’s business operations in Brazil.
  • Develop and periodically review and update policy documents to ensure continuing currency and relevance in providing requirements and guidance to management and employees, as well as follow any review and update on Scatec and/or Statoil’s policy documents.
  • Implement a “Whistleblower Channel” and “Grievance Mechanism” and ensure compliance with local data protection regulations.

Communication program:-

  • Institute and maintain an effective compliance communication program for the organization and external stakeholders, including promoting (a) use of the Whistleblower Channel” and “Grievance Mechanism”; (b) heightened awareness of the Code of Conduct as well a zero-tolerance principle, and (c) understanding of new and existing compliance issues and related policies and procedures.

Implement training programs:-

  • Work with the Human Resources Department and others as appropriate: develop an effective risk based compliance training program that includes both general and targeted training. Training programs should be based on existing programs in Statoil and Scatec, as may be reviewed and improved. In addition, establish appropriate introductory training for new employees as well as ongoing training for all employees and managers.
  • Perform training according to training plans.

Risk assessment:-

  • Conduct periodically risk assessments to identify potential areas of compliance vulnerability and risk; develop/implement corrective action plans to mitigate potential risks, and provide general guidance on implementation of defined actions and how to avoid deviation from the compliance program
  • Key project lists that are currently identified are listed in Appendix 1. The list is not exhaustive and the Compliance Officer shall review, verify and update the list as key focus areas for the position, and manage day-to-day operation of the Program and monitor the key risk areas referred to above.
  • Draft a stakeholder overview (both private and public) of persons or entities that could impact the project. In addition, keep a regulatory road map, providing an overview of legal areas where potential obligations and risk may occur.
  • Collaborate with other departments (e.g., supply chain management, engineering, project management, site management, accounting, internal auditing, business development, legal etc.) to identify potential risk and mitigating actions. Direct compliance issues to appropriate existing channels for investigation and resolution according to reporting obligations below.

Monitoring:-

  • Monitor, and as necessary, coordinate compliance activities of other departments to remain abreast of the status of all compliance activities to ensure effective implementation of compliance program and to identify potential risks or gaps.
  • Act as an independent review and evaluation body to ensure that compliance Issues/concerns within the organization are being appropriately evaluated, investigated and resolved. The Compliance Officer is expected to liaise closely with a designated Compliance Officer (or their team) from both Scatec and Statoil.
  • Monitor the implementation of the Compliance Program and related activities on a continuing basis, taking appropriate steps to improve its effectiveness and undertaking external audit as may be required.
  • Respond to alleged violations of rules, regulations, policies, procedures, and code of conduct by evaluating or recommending the initiation of investigative procedures. Develop and oversee a system for uniform handling of such violations and define the responsible for overseeing and possibly carrying out investigations.
  • Consult with Scatec and Statoil’s corporate legal functions to resolve difficult legal compliance issues.

Reporting obligations:- 

  • Provide reports on a regular basis, and as directed or requested (either by Country Manager, the Executive Committee or Chief Legal Officers of Statoil and Scatec), to keep the aforementioned informed of the operation, progress of compliance efforts, including implementation of compliance program, compliance incidents, compliance risk assessments with corresponding action plans.
  • Establish internal reporting routines for breaches and misconduct, and report accordingly.

Ensure proper reporting of violations or potential violations to duly authorized enforcement agencies as appropriate and/or required.

Qualifications and competencies:-

  • Master’s degree in Law or similar
  • Minimum 7 years’ relevant work experience in advising and working with Ebergy sector, including the regulatory framework of such industry
  • Excellent English skills, both written and verbal. Additional languages considered an advantage.
  • Experience and/or interest in the following areas:
  • Renewable energy
  • Oil/gas
  • Project development
  • Public procurement
  • FIDIC suite of contracts
